Removal From Mailing List

To have your name and address removed from Contractor Connection’s Sweepstakes mailing list, email us at sweepstakes@contractorconnect.net. Your name and address will be removed from our Sweepstakes mailing list within sixty (60) days after receipt of your request, after which time no further sweepstakes related mailings will be sent to you.

This is the first (1st) Contractor Connection Home Improvement sweepstakes.

Note, this is the first (1st) Contractor Connection Home Improvement Sweepstakes. Winners shall be posted on Contractor Connection’s website once they are fully confirmed, a process that can take several weeks.

Official Rules:

No purchase necessary to enter or win. Use of the Contractor Connection service or payment of a Contractor Connection service provider will not increase your chances of winning. The first Contractor Connection Home Improvement Sweepstakes begins at 12:01AM CST (one minute after midnight) on 07/01/2010 and ends at midnight CST on 12/31/2010.

Eligibility:

The sweepstakes is open and offered only to legal United States residents residing in the Chicagoland area (“Eligibility Area”) who are 18 years of age or older at date of entry. Void outside Eligibility Area and where prohibited. Persons in any of the following categories are NOT eligible to participate or win: (a) persons who were or are employees of Contractor Connection, doing business as Contractor Connection, or its parents, subsidiaries, affiliates, advertising and promotion agencies, service providers, prize suppliers or independent contractors of any of the above organizations; (b) individuals engaged in the development, production, website or distribution of materials for this Sweepstakes; (c) persons who are immediate family of any person in any of the preceding categories (mother, father, sibling, child or spouse), regardless of where they live; or (d) persons who reside in the same household, whether related or not, of any person in any of the preceding categories. By participating, you (and if you are a minor in the jurisdiction in which you reside (“minor”), your parent/legal guardian) agree to these Official Rules.

How To Enter:

All persons who register for Contractor Connection’s Home Improvement Sweepstakes by visiting www.ContractorConnect.net and clicking on the Home Improvement Sweepstakes banner or visiting http://www.contractorconnect.net/sweepstakes.html directly will be entered into the sweepstakes as long as they accurately fill out the required registration fields on the underlying registration form and click the “Submit” button. You may also be asked to complete a brief survey, but your answers will have no effect on your ability to participate or win. Entries must be received and recorded by Contractor Connection by 12:00 midnight CST on December 31, 2010 (12/31/2010). All persons who wish to enter the Sweepstakes must do so online through Contractor Connection’s official website (www.ContractorConnect.net).

Limit one (1) entry per household. No form of entry or participation except as stated in these Official Rules is valid. Any attempt by any household to obtain more than one (1) entry by using multiple/different names/addresses/email addresses/telephone numbers/identities or any other methods will void that household’s, and the participants of that household, entries and that household and participant will be disqualified. Entries become the sole property of Contractor Connection.

Drawing:

One winner will be selected in a random drawing held on or about 12/31/2010, from all eligible entries received by Contractor Connection, whose decisions are final and binding in all matters relating to this Sweepstakes. Winner will be notified by mail or overnight mail, or by such other method as determined by Contractor Connection, on or about 01/07/2011. No substitution, cash redemption or transfer of prize, but Contractor Connection reserves the right to substitute prize with prize of equal or greater value if advertised prize becomes unavailable.

Grand Prize/Odds:

One Grand Prize: A $5,000 credit to be used with any Qualified (as defined below) Contractor Connection Service Provider(s) to repair or improve your home. Prize can only be used in the Eligibility Area with Qualified Contractor Connection Service Provider in good standing with Contractor Connection at the time the work/services are commissioned/contracted. (Decisions regarding which Contractor Connection Service Providers are in good standing shall be solely determined by Contractor Connection. Only Contractor Connection can make and confirm such good standing.) If the winner does not own the property on or in which the work/services are to be performed or conducted, Contractor Connection may require written permission of the property owner to perform or conduct the work/services. (The decision to require the owner’s permission shall be solely determined by Contractor Connection). Prior to contracting for any work/services, winner must contact a Contractor Connection customer representative and obtain the written approval by Contractor Connection of the Service Provider(s). Any work/services commissioned/contracted must be commissioned/contracted no later than 06/30/2011, and any prize credit remaining thereafter for which no commission/contract has been executed will be forfeited; and the work/services must be completed by 12/31/2011. Should winner commission/contract for work/services in an amount in excess of the prize credit, that excess will be the sole responsibility of the winner. The credit may only be applied to actual work/services and materials (both as solely determined by, and subject to the approval of, Contractor Connection) but cannot be applied to costs, expenses and fees associated with and/or for, but not limited to, mortgages, loans, inspections, permits, licenses, assessments, variances, environmental remediation including mold, hazardous material abatement and/or removal, and insurance. If winner is not of the age of majority in his/her state of residence, prize may be awarded in the name of or to winner’s parent or legal guardian (as solely determined by Contractor Connection) who must agree to all undertakings of winner set forth in these Official Rules both on behalf of himself/herself and winner, or winner may be disqualified and prize will be awarded to an alternate winner. Expenses and costs not stated are solely the responsibility of the winner. If winner cannot accept the prize as stated, prize will be forfeited in its entirety and awarded to an alternate winner. Odds of winning depend on the number of eligible entries received. All taxes, including but not limited to sales and income taxes, are solely the responsibility of winner.

General Conditions:

By participating, participants (and participants parent/legal guardian if participant is a minor) release, and agree to indemnify and hold harmless Contractor Connection and all of their respective employees, officers, directors, representatives and agents (individually and collectively “Releasees”) from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses (whether due to negligence or otherwise) to person(s), including death, and/or property which may be sustained, directly or indirectly, in whole or in part, in connection with participation in the Sweepstakes and/or the receipt, ownership or use/misuse of any prize (or portion of a prize) and/or participating in any prize-related activity. Releasees make no warranty or representation, express or implied, in law or in fact relative to any work or services performed by any Contractor Connection Service Provider(s); and Contractor Connection makes no warranty or representation, express or implied, in law or in fact relative to any work or services performed by any Contractor Connection Service Provider(s). Each participant warrants and represents that they are eligible to participate in the Sweepstakes.

Winner (and winner’s parent/legal guardian if winner is a minor) will be required to complete, sign and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within 10 days of receipt of documents. If documents are not returned timely, or if the prize notification or prize is returned as non-deliverable, or if the winner is found to be ineligible or otherwise not in compliance with these Official Rules, prize will be forfeited in its entirety and an alternate winner selected.

By accepting the prize, the winner (and winner’s parent/legal guardian if winner is a minor) agrees (and will confirm that agreement in writing upon request) that Contractor Connection, and those acting pursuant to the authority of Contractor Connection, shall have the right to use the winner’s name, voice, and likeness, statements and pictures, films or recordings made thereof, and prize information, at any time or times, in any manner and in any media now known or hereafter discovered, worldwide, including on the World Wide Web and the Internet, for advertising, trade and promotional purposes, in perpetuity, without further consideration for such use, where permitted by law, and without notification, review, or approval. The entry information provided is subject to the Privacy Policy at www.ContractorConnect.net. To read the Contractor Connection Privacy Policy, please visit http://www.contractorconnect.net/privacy.html.

Liability Limitations:

Releasees are not responsible for lost, late, misdirected, incomplete, entries or email; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Web site, telephone or other connections availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Persons who tamper with or abuse any aspect of this Sweepstakes, or are in violation of the Web Site’s User Agreement as solely determined by Contractor Connection, will be disqualified. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods, and disqualify any entrant using such methods. Releasees are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the Web site. Should any portion of the Sweepstakes be, in Contractor Connection’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which in the sole opinion of Contractor Connection, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Contractor Connection reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes, and select winner from entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Releasees are not responsible for any incorrect or inaccurate information, whether caused by Web Site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes, and assume no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized use of this Web Site. In case of dispute, the authorized subscriber of the email account used to enter the promotion at the actual time of entry will be deemed to be the participant, and must comply with these Official Rules. The authorized account email subscriber is deemed to be the natural person who is assigned an email address by an Internet Service Provider (ISP), on-line service provider, or other organization that is responsible for assigning email addresses. Any attempt to deliberately damage any Web site or undermine the legitimate operation of the promotion is unlawful and subject to legal action by Contractor Connection or its agents.

Choice of law/dispute resolution

Except where prohibited, by participating in the Promotion you (and your parent/legal guardian if you are a minor) agree that: (a) any action at law or in equity arising out of or relating to these Official Rules or the rights and obligations of any participant and any Releasees shall be filed only in the state or federal courts located in the County of Cook in the State of Illinois and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action, (b) any and all disputes, claims, and causes of action arising out of or connected with these Official Rules and/or the rights and obligations of any participant and/or and Releasees shall be resolved individually, without resort to any form of class action, and (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Promotion but in no event attorneys' fees; and (d) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant and any Releasees shall be governed by and construed in accordance with the laws of the State of Illinois without giving effect or regard to any principles or doctrines of conflicts of law in and of the State of Illinois or any other jurisdiction.

IN NO EVENT WILL RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEB SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID WEB SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS WEB SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. To find out who won the Sweepstakes, send an email to sweepstakes@contractorconnect.net no later than 12/31/2011.

Once confirmed, the winner’s name will also be posted at www.ContractorConnect.net.
